In the argument, it is simply pointed out that no portion of my alleged confession is admissible according to law, since it is said to have been made before police personnel. Such measure (which I believe to be also applied in Mexico since some ten years ago) has precisely the aim of avoiding “confessions” obtained under physical torture or threats.
Under physical torture and threats I was forced to sign a “confession”, according to which I killed Cécile in Madurai City. Later they made me write myself another one, where it is stated that I killed her in my apartment at Kalasalingam University, and then took the corpse to Madurai. However, none of them was submitted to court, but a third one which does not even have my signature.
Now I will mention some points which show that such “confession” does not correspond to reality, and cannot have been stated by me:
1) I was arrested near Thiruparankundiram Poonga bus stop on Tuesday, April 17, 2012.
In reality I was (illegally) arrested at the building where I lived in Kalasalingam University on Monday, April 16, at 22:30, and I was taken to Madurai along with my daughter and two of my neighbors. This is confirmed in the deposition of Prof. Vijayakartik, one of my neighbors who was forced to go to Madurai City on Monday night, and I believe that it is also mentioned in the deposition of Inspector Mukkan, who was in charge of Krishnankovil police station at the time. Both of them where witnesses called by the prosecution.
2) I stabbed Cécile in her leg and I broke one of her wrists.
In the postmortem there is no mention of any wound made with a knife or similar object, nor of any broken bone in the corpse. However, it is stated the presence of a heat split (that is, a long and thin wound caused by heat) in one of the legs. Probably the police assumed that such wound had been made with a knife, and that is why such a statement appears in my alleged confession.
Both in the alleged confession and in the Charge Sheet, a long scene of extreme violence is described: I first stab her, then break her wrist, she defends my attacks, and I finally smash her head against the wall. In the building where we lived there are eight apartments, and seven of them were occupied at the time. In the apartment next to ours lived a professor with his wife and little daughter, and the latter two never went out. In the floor below ours, there lived a couple of professors with their little son and a grandmother, and these two were also always at home. How is it then possible that none of the neighbors heard anything?
3) Petrol Bunks.
How can I know the precise amount of petrol bought in each petrol bunk, as well as the kind of bottle it was put in (that is, its brand), and the brand and detailed address of each petrol bunk? Most people ignore the address of the petrol bunk they use regularly (neighborhood, street, and street number), how can I know the address of several petrol bunks in a city I did not live in? I believe this shows clearly that such confession cannot have been made by me.
4) I burnt her cell phone and other belongings along with the body.
Why are there no remains whatsoever of such objects, when according to the police some of the hair was not burnt, and the intact portion of the clothes worn by the person was enough to identify them as a nightie?
It is worth mentioning that in the Charge Sheet it is mentioned that the corpse had been enveloped in plastic and tied up with a rope, but no trace of such materials is presented as evidence. Similarly, it is stated that the metal frame of the travel bag used to keep the corpse was found, but it is also not presented as evidence.
5) I went to a car broker in Madurai City.
Why was then such broker not called as a witness? Why is the name and location of the shop not mentioned anywhere?
6) I tried to flee to Mexico.
Then, why did I not buy tickets to Mexico, nor I canceled the ones I had to Pune, where I was going to deliver a series of lectures at the beginning of May?
